Copyright Respect

Portfolio Pro ("we," "us," or "our") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act ("DMCA") and other applicable laws, we have adopted a policy of terminating, in appropriate circumstances, users who are deemed to be repeat infringers.

We may also, at our sole discretion, limit access to our service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

Filing a DMCA Takedown Notice

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via our service, you may notify our Designated Copyright Agent, as set forth below.

⚠️ Important: False Claims

Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability. Please ensure that you have a good faith belief that use of the copyrighted material is not authorized.

Required Information for DMCA Notice

For your complaint to be valid under the DMCA, you must provide the following information in writing:

  1. Identification of the copyrighted work: Identify the copyrighted work that you claim has been infringed. If multiple copyrighted works are covered by a single notification, you may provide a representative list of such works.

  2. Identification of the infringing material: Identify the material that you claim is infringing and provide sufficient information to allow us to locate the material on our service (e.g., URL, lesson name, project ID).

  3. Contact information: Provide your contact information, including your full name, mailing address, telephone number, and email address.

  4. Good faith statement: Include the following statement: "I have a good faith belief that use of the copyrighted material described above is not authorized by the copyright owner, its agent, or the law."

  5. Accuracy statement: Include the following statement: "I swear, under penalty of perjury, that the information in this notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."

  6. Physical or electronic signature: Provide your physical or electronic signature.

Filing a DMCA Counter-Notice

If you believe that material you posted was removed or access to it was disabled by mistake or misidentification, you may file a counter-notice with us by providing the following information:

  1. Identification of the material: Identify the material that has been removed or disabled and the location where it appeared before removal (e.g., URL, lesson name).

  2. Statement under penalty of perjury: Include the following statement: "I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled."

  3. Contact information: Provide your full name, address, telephone number, and email address.

  4. Consent to jurisdiction: Include the following statement: "I consent to the jurisdiction of the Federal District Court for the judicial district in which my address is located (or the Northern District of California if my address is outside of the United States), and I will accept service of process from the person who provided the original DMCA notification or an agent of such person."

  5. Physical or electronic signature: Provide your physical or electronic signature.

What Happens After You File

After Filing a Takedown Notice:

  1. We will acknowledge receipt of your notice within 1 business day (if submitted electronically).

  2. We will review your notice to ensure it meets DMCA requirements (typically within 2-3 business days).

  3. If valid, we will remove or disable access to the allegedly infringing material promptly.

  4. We will notify the user who posted the material that it has been removed or disabled.

  5. The user may file a counter-notice if they believe the takedown was in error.

After Filing a Counter-Notice:

  1. We will forward your counter-notice to the party who filed the original takedown notice.

  2. If the original party does not file a court action within 10-14 business days, we will restore the removed content.

  3. If the original party files a lawsuit, we will keep the content disabled until the legal matter is resolved.

Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers.

Account Termination

We may also terminate the accounts of users who, in our sole discretion, are determined to be repeat infringers. This includes users who have received multiple valid DMCA takedown notices or who repeatedly post content that infringes on others' intellectual property rights.

User-Generated Content Policy

Portfolio Pro allows users to post projects, code samples, and other content. Users are solely responsible for ensuring they have the right to post such content.

User Responsibilities:

  • Do not post content that infringes on others' copyrights, trademarks, patents, or other intellectual property rights

  • Ensure you have proper licenses or permissions for any third-party code, libraries, or assets you include

  • Include appropriate attribution and license notices for open-source code

  • Respect software licenses (GPL, MIT, Apache, etc.)

  • Do not post proprietary code from your employer or other companies without authorization

Safe Harbor Provisions

Portfolio Pro qualifies for safe harbor protections under Section 512(c) of the DMCA for user-generated content. We:

  • Do not have actual knowledge of infringing material

  • Do not receive a financial benefit directly attributable to infringing activity

  • Respond expeditiously to remove or disable access upon notice

  • Have designated a DMCA agent and posted this policy

  • Implement a repeat infringer policy

Open Source & Licensing

Portfolio Pro is built using open-source software and respects all applicable licenses. Our platform includes:

  • Code examples and tutorials that use open-source libraries (properly attributed)

  • User projects that may incorporate open-source code (users must comply with licenses)

  • Our own proprietary content (lessons, course materials) which is copyrighted

Trademark Policy

"Portfolio Pro" and our logo are trademarks of Portfolio Pro. Unauthorized use of our trademarks may violate trademark laws.

Educational Fair Use

Portfolio Pro is an educational platform. We believe that certain uses of copyrighted material for educational purposes may qualify as fair use under Section 107 of the Copyright Act. However:

  • Fair use is determined on a case-by-case basis

  • Educational use does not automatically mean fair use

  • Users should not assume fair use applies to their content

  • When in doubt, seek permission or use your own original content

International Copyright

While this policy is based on US copyright law (DMCA), we respect international copyright laws and treaties. If you are outside the United States and believe your copyright has been infringed, you may still file a notice using the process above.
